Environmentally Approved Construction Sources
All material sources, waste sites, and staging areas must be reviewed by LHTAC Environmental Staff before use to ensure that those sites have met all environmental requirements. Operations that meet the Federal Highway Administration’s (FHWA) definition of ‘commercial’ do not require additional approvals from other agencies (such as the Idaho Transportation Department (ITD), the State Historic Preservation Office (SHPO), etc.).
FHWA defines a commercial operation as “an established lawful business, operating at the time of bid opening, as a source to the general public. Sources must clearly be established prior to the project, exist independent of the project, and sell aggregate materials to any purchaser. There must be no causal relationship between the project and the materials source”. No environmental clearance or review is required for the waste, staging, or material use of these commercial sites. It is the responsibility of the commercial operation to comply with all Federal, state, and local environmental and cultural resource laws, regulations, and ordinances.
The following link/table is a list of LHTAC-approved commercial operations located in Idaho, Washington, and Utah. No additional environmental approval is needed from LHTAC for the use of these contractor support areas*.
*PLEASE NOTE: Contractor support areas included on an ITD QAMS list still need LHTAC environmental clearance.
If your desired material source, waste site, or staging area is not listed in the table, then you do not have environmental clearance to use those sites.
